If you currently own a lot and are interested in building a commercial structure that will generate an average daily flow of 1,000 gallons per day (GPD) or less, you will need to have an approved sanitary design before you can obtain a building permit. The sanitary design must be approved by the County Health District.
If the commercial structure will generate an average daily flow of more than 1,000 GPD or the local health department has not signed a Memorandum of Understanding (MOU) with Ohio EPA, you will have to obtain a Permit to Install (PTI) from Ohio EPA. A list of counties that have signed MOUs can be found here. Small commercial sanitary systems are also referred to as small flow on-site sewage treatment systems (SFOSTS).
The system design should comply with local health department guidlines/regulations and with OAC 3701-29. The type and size of system will depend upon the lot size, daily flow rate and soil type. It is important to note that the new rules strongly emphasize the use of onsite dispersal systems (i.e., leach fields, mounds, drip irrigation, etc.) vs. discharging offsite.
